That we find in the proposed Ordinance several enactments, (particularly clauses 5 & 8) altogether at variance with the Law of England, & not (as it appears to us) justified in their application to the Colony
"That it appears to us desirable as far as possible to keep the Criminal Law in the Colonies & Settlements, in conformity with that of the Mother Country."
"That besides the foregoing objection, it appears to us that some of the enactments of the Ordinance are in themselves objectionable.
That we cannot therefore recommend that the Ordinance in question should receive the sanction of Her Majesty.
